May attorney demand the insurance policy from opposing insurance prior to litigation?


Before an attorney has filed a claim or began litigation at all, can he or she obtain the insurance policy from the opposing party's insurance company? Technically, there is no "opposing party" yet because no claim has been filed. It seems to me that he could if the insurance co. gave it to him, but if not, he'll have to make a discovery demand when litigation has begun? Any help or direction would be great, thanks!

He can't force them to give him the policy if no case is filed, but generally, requests like that are honored...no one wants a lawsuit, so insurance companies to to handle this stuff as simply as possible.
