Is it illegal for my parents to take me off their health insurance if I'm living with them....?

Postby Namy » Sun Aug 01, 2010 7:27 am

I'm 18 and a sophomore in college. I moved in with my mother and step-father a year ago and he still refuses to put me on his health insurance. My current health insurance expires when I turn 19 and I can't afford to buy my own or to buy my school's health insurance. Is it illegal for my step father to refuse to put me on his health insurance if I am a full time student and passing all of my courses?

He can keep you in his insurance as long as you are in college.Offer to pay your portion of his health cost premium if he is that gosh darn cheap. And no, it's not illegal for a parent to remove a child from insurance./

No, of course it is not illegal. There is no law requiring any parent to provide any type of insurance for their children at any time -- especially when that "child" is actually an adult.I'm sorry your stepdad isn't being very helpful to you -- but he's breaking no laws.Could you possibly offer to pay your share of his insurance coverage? Would that be cheaper than getting it through your school? If not, then the school insurance seems to be your only choice. You can build the cost of that insurance in to your financial aid package. Talk to the people in your school's financial aid office.Does your biological dad have any kind of insurance plan? Could he add you to his?

No. If your mother and father are divorced and the divorce court judge ordered your mother to provide health insurance until a certain age, then she is bound by that. If there is no court order or your father died while married to your mother, then she is not required to provide you with anything after you turn 18. Either way, your stepfather is not required to provide you with anything, at any age. This includes a place to live. They do not have to let you live with them. This raises another point. Since you are 18, you could live alone and might qualify for medicaid as a person living alone with no money or job. However, if you cannot afford health insurance, then you also cannot afford a place to live alone. So forget that idea.

It is perfectly legal. They are not required to provide your insurance coverage.

It is their choice to include you on their insurance or not. I suspect that under the old rules you had to stay in college and at age 19 you could be dropped from their policy. However, after September, the new Obama health care bill allows you to stay on parents insurance whether or not you are in school until you are 26. The only catch is you cannot have an employer health care plan if you are working. Maybe these websites can help.http://www.hhs.gov/news/press/2010pres/07/20100714a.htmlhttp://edlabor.house.gov/blog/2010/03/affordable-health-care-for-ame.shtmlhttp://healthreform.kff.org/

Oh, no. No law requires your parents to put you on their health insurance, or buy it for you. Regardless of how old you are. They have NO obligation, by law, to have any kind of insurance for you. Now, when 2014 rolls around, they'll be required to get insurance for their MINOR children. But that's not you.Don't confuse the way things are - IF his employer offers health insurance (and they aren't required to), and IF the employer offers access for dependents (which they aren't required to), and IF you qualify (which you do, as long as you're his dependent on his taxes, and a full time student), and IF HE WANTS TO, he can add you. But he sure isn't forced to add you.Just think of it this way - private insurance for a healthy 19 year old, is MUCH cheaper than adding them to a group policy. So if you think it's expensive to buy your own, it could cost stepdad TWICE that, to add you to his policy at work! There ARE employers that offer health insurance to part time employees - Walmart, Starbucks, and UPS come immediately to mind.

No it is not illegal for your stepfather to refuse to pay for your health insurance. You are 18 and legally an adult. The fact that you are a full time student does not mean that it is your mother and stepfathers job to provide health insurance for you. Health insurance can be very expensive. It may not be affordable for him to pay for you. You might want to consider getting a job to pay for your own benefits.
